BELLINGHAM, WA (MyBellinghamNow.com) – Tech-giant Amazon is arguing that the National Labor Relations Board (NLRB) is unconstitutional, echoing other large companies’ similar stances.

Elon Musk’s SpaceX and the grocery store chain Trader Joe’s made arguments last month that are similar to the Seattle-based company’s Thursday filing. The previous arguments were made when dealing with disputes over workers’ rights and organizing.

Amazon’s legal filing responds to a complaint that alleges the company unlawfully retaliated against New York City warehouse workers when they voted to unionize nearly two years ago. In the legal filing, the tech-giant denies many of the charges and asks for the complaint to be dismissed.

In addition, the attorneys argue that the NLRB violates the separation of powers and infringes on executive powers laid out in the US Constitution. The filing also says the NLRB denies the company a trial by jury, violating due process rights.

A NLRB spokesperson declined to comment, and Amazon did not respond to a request for comment.
