GOLDENDALE, WA (MyBellinghamNow.com) – The so-called “millionaire’s tax” is receiving yet another legal challenge.

The Citizen Action Defense Fund filed a lawsuit against the state earlier Thursday, April 9 along with former state AG Rob McKenna and former state Sen. Phil Talmadge.

Filed with Klickitat County Superior Court, the coalition of business owners, farmers and industry associations are backed by the legal team with the conservative nonprofit.

McKenna says the legislators and Governor Bob Ferguson that advocated for this law are going against several court precedents in Washington:

“A series of Supreme Court decisions have reached the obvious conclusion that income, being part of everything and being an intangible and being subject to ownership, is covered by that definition of property,” he said during the press conference. “That means Washington State can have an income tax if it follows the rules for property taxes, it has to be uniform and no higher than 1%.”

The suit alleges that legislators violated the constitution by passing the bill.

Both McKenna and Talmadge believe their suit will advance to the state Supreme Court, and Talmadge says it will likely be heard after the November election.

This follows another challenge from Let’s Go Washington, which said they were suing state Sec. of State Steve Hobbs the week of the bill’s signing.
