The man was taken into custody on July 16 but was released on bail on Friday, July 19.
The man faces upwards of 10 years in prison and a $20,000 fine for each felony count.
The driver was booked into the Whatcom County Jail after his release from the hospital.
Councilmembers will vote on the ordinance at their next committee of the whole meeting.
No suspects have been identified at this time, and anyone with information is asked to call the University Police.
